Terms of Service

1. About DiveHUD
DiveHUD ("we", "us", "our") is a web application that converts Garmin dive computer logs (.FIT files) into video overlays for use in video editing software. DiveHUD is operated by Brad James, New Zealand.
2. Acceptance
By creating an account or using DiveHUD you agree to these Terms. If you do not agree, do not use the service.
3. Your account
You sign in with Google. You are responsible for keeping your account secure. We may suspend or terminate accounts that violate these Terms.
4. Credits and payments
DiveHUD uses a credit system. 1 credit = 1 overlay export. Credits are purchased in packs and are valid for 365 days from purchase. Unused credits expire after 365 days and are non-refundable. Free credits granted on sign-up reset monthly and do not carry over. All prices are in USD. Payments are processed by Stripe.
5. Exports and storage
Rendered overlay files are available for download for 48 hours after creation, then permanently deleted. We do not store your .FIT files after parsing — they are deleted immediately once dive data has been extracted.
6. Acceptable use
You may not use DiveHUD to upload files you do not own or have rights to, attempt to reverse-engineer the service, or engage in any activity that disrupts the service for other users.
7. Intellectual property
You retain all rights to your dive data and exported overlays. We retain all rights to the DiveHUD software, brand, and service.
8. Disclaimers
DiveHUD is provided "as is". We do not guarantee uninterrupted service or that rendered outputs will meet your specific requirements. Dive overlays are for creative/entertainment purposes only and must not be relied upon for safety, navigation, or dive planning.
9. Limitation of liability
To the maximum extent permitted by New Zealand law, our total liability is limited to the amount you paid us in the 12 months preceding the claim.
10. Governing law
These Terms are governed by the laws of New Zealand. Disputes will be resolved in the courts of New Zealand.
11. Changes
We may update these Terms. Continued use after changes are posted constitutes acceptance. Material changes will be notified by email.
